Data Privacy Statement for Support Enquiries

In compliance with Articles 13 and 14 of the European Union Regulation 2016/679 on the protection of Personal Data (hereinafter “GDPR”), COSMED S.R.L. (hereinafter “COSMED”) provides the following information regarding the use of personal data (hereinafter “Data”) you provide.

1. Data Controller

COSMED has not appointed a Data Protection Officer, as it does not process data falling under the scope of Article 37 of the GDPR.

2. Purpose and legal basis of processing

COSMED S.R.L., in handling requests for technical support and services related to its products, will process your Data in compliance with applicable data protection laws.

Processing is lawful pursuant to Article 6 of the GDPR for the management of organizational and administrative procedures necessary to satisfy your request for:

I) Installation and/or training on COSMED products;
II) Technical assistance on COSMED products;
III) Software updates for COSMED products;
IV) Registration of COSMED products.

The Data you provide by e-mail or through the dedicated form on the institutional website will be used solely for the purposes above (hereinafter “Purpose”). Provision of your Data is mandatory; without it, COSMED cannot fulfill your request. Consent is not required for this processing, as it is based on the legal grounds indicated above.

3. Processing methods

The Data will be entered into the COSMED information system and lawfully processed by authorized and trained personnel pursuant to Article 29 of the GDPR, in a transparent and responsible manner, using manual and partially automated tools to perform the operations listed in Article 4.2 of the GDPR: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, deletion, and destruction. Data will not be subject to automated decision-making processes such as profiling.

4. Data transfer

Your Data may be communicated by COSMED to external subjects and/or companies collaborating in the execution of organizational, administrative, and tax procedures related to the Purpose, which may operate outside the European Union. This includes companies providing administrative, accounting, sales, and support services on behalf of COSMED, as well as COSMED-controlled companies. Data may also be communicated to Italian and European authorities and public bodies if required by law.

5. Retention period

Your Data will be stored in accordance with the principles of necessity and proportionality for a period of five (5) years, after which it will be deleted, subject to any legal obligations.

6. Rights of the data subject

Your Data will be processed respecting your rights under Articles 15 to 22 of the GDPR, including the rights to access, rectify, erase, limit processing, data portability, and object to processing. You may exercise your rights or lodge a complaint regarding GDPR violations with the Data Controller above or with the relevant Data Protection Authority.
